Overview: Welcome to OKO Labs, Inc. d/b/a WriterGenie. These Terms of Service (“Terms”) govern your access to and use of our services, including our website, mobile applications, and any other platform through which you access our offerings (collectively, the “Service”). You agree to be bound by these Terms by accessing or using our Service.
Acceptance of Terms: Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. If you disagree with any part of the Terms, you may not access the Service.
Service: Refers to the services provided by WriterGenie, including our website, mobile applications, and any other platform through which you access our offerings.
User: Refers to the individual using our Service. Content: Refers to any information, text, graphics, or other materials uploaded, downloaded, or appearing on the Service.
Account Creation: To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security: You are responsible for safeguarding your account credentials. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.
Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.
Acceptable Use: You agree to use the Service in accordance with all applicable local, state, national, and international laws and regulations. You will not engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service. User-Generated Content: By submitting, posting, or displaying Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods. This license includes the right for us to use your Content to train our AI models, even if you delete your account or remove the Content from the Service. You acknowledge and agree that we may retain copies of your Content and continue to use it in accordance with this license, even after you delete your
account or remove the Content from the Service.
Restrictions: You may not (a) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Service; (b) use the Service for any purpose that is illegal or prohibited by these Terms; (c) exploit any part of the Service for commercial purposes without our express consent.
Ownership: All rights, title, and interest in and to the Service (excluding Content provided by users) are and will remain the exclusive property of OKO Labs, Inc. d/b/a WriterGenie and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
User Content: You retain ownership of any intellectual property rights that you hold in the Content you create. However, by providing Content to the Service, you grant us a worldwide, perpetual, irrevocable, transferable, license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such Content for the purpose of operating and improving our Service and developing new ones.
Feedback: Any feedback, comments, or suggestions you may provide regarding the Service is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.
User Conduct: You agree to use the Service responsibly and to refrain from engaging in any activity that could harm the Service, other users, or third parties. This includes, but is not limited to, uploading malicious software, attempting to gain unauthorized access to the Service, or harassing other users.
Content Standards: You are solely responsible for the content you upload or share on the Service. You agree not to post content that is illegal, offensive, defamatory, or in violation of intellectual property rights. Violations: We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms, including removing offending content, suspending or terminating the account of such violators, and reporting violations to law enforcement authorities.
Service Fees: Some features of the Service may require payment. All fees are non-refundable and are billed in advance. We reserve the right to change our pricing terms at any time, and we will provide you with notice of any such changes.
Payment Methods: By providing a payment method, you expressly authorize us to charge the applicable fees on said payment method as well as taxes and other charges incurred thereto, all of which depend on your use of the Service.
Billing Issues: If any fee is not paid in a timely manner, or we are unable to process your transaction using the payment method provided, we reserve the right to revoke access to your account.
User Termination: You may terminate your account at any time by contacting our support team. Upon termination, you will lose access to all features of the Service associated with your account.
Company’s Rights: We may suspend, disable, or delete your account (or any part thereof) or block or remove any content you submitted if we determine that you have violated any provision of these Terms or that your conduct could harm our reputation. We may also terminate your account if we decide, in our sole discretion, to discontinue offering the Service.
Effect of Termination: Upon termination, all licenses granted by us will terminate. In the event of account deletion for any reason, content that you submitted may no longer be available. We are not responsible for the loss of such content.
No Warranties: The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the fullest extent permitted by applicable law, OKO Labs, Inc. d/b/a WriterGenie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any unauthorized access to or use of our servers
and/or any personal information stored therein.
Indemnity: You agree to defend, indemnify, and hold harmless OKO Labs, Inc. d/b/a WriterGenie, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms
